Default Anybody have an experience with GISOL and their Anytime Money Back Guarantee ?

Hi,

I'm not sure if my problem is ok to post here but I really need some advice .

Recently I signed up with gisol.com with there linux unlimited plan, the night of the day i signed up their staff called me at 2am my asia time about upgrading the package to something about $466 . It was 2 am but the number woke me up.

I tried to tell him that i don't want and i want to stay with what i have now, didn't work and he kept talking . so i have to say "ok, you send me your details to my email and i will take a look at it "

in the morning i received an email as a receipt of the charge to my card for $466.

i contacted them to cancel the plan cause i belived in what they post on their website " Anytime Money Back Guarantee " , i thought i will get my money back.

BUT this is what they say "
" Anytime Money Back Guarantee" All of our virtual web hosting
packages come with an Anytime Money Back Guarantee.� This means
hat you may cancel your web hosting package at any time and
receive _*credit*_ for the unused portion of your account _*minus
promotional fees*_, if any, will be deducted from the amount of
your _*credit*_.
This means that the $466.20 that you have submitted for the
payment of your account will be pro-rated according to our policies and
provided as company credit to be used for additional or alternate services with GISOL, Inc.

"

it means i'll never get my money back and i will never go back to their service .

$466 can get me another good hosting (s) who really do Money Back Guarantee to my card .

Please if anybody have any advice on what i should do or share your ideas. I'll be greatly appreciated.

I personally haven't heard of gisol. I looked at the webpage and couldn't even find any "Terms of Service" etc.

I would first call them back and demand a refund. If they stick to their story of pro-rating and other fee's as you described. Ask for it either in writing or ask them to tell you where this verbiage is in the sign-up process.

If they *do* provide it and it *is* in your sign-up contract...then *you *may not* have any recourse other than your word against theirs about them pulling a bait and switch sort of tactic.

Otherwise, I would just call my credit card provider and place a Dispute of Charge Claim with them. You will have to complete either a written or web based claim most likely, detailing your side of the story. Then the credit card company will contact gisol and get their side of the story. Most of the time the credit card companies can settle the dispute in your favor and/or once you do file a Dispute, the merchant (gisol) will back away and do a refund.

That's the best advice I can give you and exactly what I would do. If that doesn't get it settled, then file a claim with the Better Business Bureau of Santa Monica or wherever they are located. Doesn't get you much but some businesses and customers do check for complaints before doing business with companies whom have a bad reputation.

I just think they better say ANYTIME CREDIT BACK GUARANTEE than ANYTIME MONEY BACK GUARANTEE on their homepage.

link to their policies is on the very very bottom of the homepage, a small one link there and not easy to be noticed .

Anyway, I contacted my credit card provider couple days ago and hope they can help.

If not, I probably try your suggestion to file a claim with the Better Business Bureau. I just think if it could happen with me it could be happening to somebody else and I just don't think this is a fair business.

They have a qualified lawyer who pops online to answer questions, might be worth a go at posting there as we can only offer our opinions, always better to go for someone who knows the law.
